TERMS AND CONDITIONS – Smart Moov Biarritz Chauffeur LLC
ARTICLE 1 – ACCEPTANCE
Any booking made with Smart Moov Biarritz Chauffeur LLC implies the full acceptance of these terms and conditions of sale. These general conditions of sale are concluded between Smart Moov Biarritz Chauffeur, registered in the Bayonne Trade and Companies Register under number 881752067 (“Smart Moov”) and any person, whether acting professionally or not, (hereinafter the “Customer”) wishing to book a chauffeured car service or VTC (hereinafter the “Service”) for themselves or for other individuals duly authorized for this purpose (the “Passenger(s)”). By booking a Service with Smart Moov, the Customer and Passengers fully and unreservedly accept Smart Moov’s terms and conditions of sale (hereinafter the “Terms and Conditions” or “GTC”). Any opposing condition from the Customer or Passenger, including any clause that arises from their own general conditions, cannot be enforced against Smart Moov without express, written, and prior acceptance from Smart Moov. Smart Moov reserves the right to modify the GTC at any time. The Conditions of Sale applicable to a booking are those in effect on the date of the confirmed booking, as evidenced by Smart Moov’s receipt of a written confirmation of the reservation. Smart Moov guarantees the proper organization and execution of the transportation services entrusted to it.
ARTICLE 2 – BOOKINGS
All services must be confirmed in writing. Reservations can be made on our website at www.smart-moov.com, by phone at +33 (0)6.87.06.15.02, or by email at [email protected]. An email confirming availability will be sent by our services. All bookings must be made no later than 24 hours before the service begins. They must be made by the client or an authorized agent. Each booking must include the following information: the customer’s name and contact details (address, email, phone), the pick-up and drop-off addresses for transfers, the duration of the availability, the date and time of the service, the number of passengers, and the approximate number, weight, and volume of luggage. A confirmation email or SMS will be sent to the customer, who accepts these terms and conditions.
QUOTE
Upon receiving a booking request, Smart Moov will provide a quote based on the information given by the Customer or Passenger. Any changes to the provided information may alter the initial price of the Service (change of vehicle model, capacity, mileage, duration, etc.). Any service not included in the original quote is billed additionally.
BOOKING CONFIRMATION
If the Customer accepts the quote, they must confirm their booking in writing using methods approved by Smart Moov (the “Booking Confirmation”). The receipt of the Confirmation by Smart Moov forms the contract of carriage between Smart Moov and the Customer.
ARTICLE 3 – SERVICE
The service is valid for a single use.
Service Types:
- Transfer: Reservation of a chauffeured vehicle for a one-way or round trip between a predetermined departure point and a destination. The distance and duration of the service determine the final price, according to our other conditions of sale.
- Provision or Hourly Service: Reservation of a chauffeured vehicle for a specified period starting at a predefined departure point. The duration determines the final price, which is set at a fixed hourly rate. Each hour of service includes a maximum distance of 25 kilometers per hour.
The service starts at the pick-up location on the day and time agreed upon during booking. It ends upon drop-off at the agreed destination or at the end of the availability period, as previously established during booking.
In case of customer delay, the driver will wait 10 minutes at the pick-up location. After this period, Smart Moov Biarritz Chauffeur LLC will consider the service as canceled. The full cost of the service will be invoiced, and no refund will be issued.
If the customer is not present at the pick-up location, the service will be definitively lost, charged to the customer, and will not entitle them to any refund. If the customer is unable to find the driver, they must immediately call Smart Moov Biarritz Chauffeur LLC to avoid being charged the full amount of the service.
Respect and proper use of the equipment is required. Any damage to the equipment or any harm caused inside the vehicle will be borne by the customer and invoiced. Smoking is strictly forbidden inside the vehicle. Seat belts must be worn at all times in both the front and back seats. Animals are not allowed inside the vehicle, except if they are in a proper cage or bag.
Smart Moov Biarritz Chauffeur LLC is not responsible for any items forgotten in the vehicle or elsewhere during the service. Under no circumstances may the customer demand the driver to exceed speed limits or violate traffic regulations. More generally, the driver reserves the right to refuse any request that they consider likely to compromise the safety of the vehicle occupants and other road users.
Our drivers are professionals whose responsibility is to comply with and enforce current laws. Smart Moov Biarritz Chauffeur LLC reserves the right to immediately terminate any service if the customer’s behavior jeopardizes the safety of the driver, the vehicle, or other road users. In such cases, the full service fee will be charged. Customers who are visibly intoxicated or behaving offensively will not be allowed to board the vehicle, and the full fee will be charged.
Luggage capacity is proportional to the vehicle’s capacity, and luggage remains the responsibility of the transported individuals throughout the service. Any changes to the route requested by the customer may incur additional fees.
The service provided by Smart Moov Biarritz Chauffeur LLC, regulated by Articles L.231-1 to L.231-4 and R.231-1 to R.231-9 of the French Tourism Code, involves providing a vehicle along with the services of a driver.
The service includes:
- The vehicle at the customer’s disposal
- The provision of a driver speaking at least French
- Professional insurance for passengers, kilometers traveled, vehicle maintenance, fuel, and the service duration as determined at booking
- The transportation of customer luggage, within the vehicle’s capacity limits
- The cost of tolls
- The cost of parking
The service does not include:
- Entrance fees to sites (museums, theaters, castles, stadiums, etc.)
- Entrance fees to public places
Smart Moov may subcontract, transfer, or assign all or part of the Service to a third party of its choice without prior notice to the Customer.
The photographs and images available on the Smart Moov website, brochures, or promotional material are non-contractual. Smart Moov will not be held responsible if the car and/or driver do not match the photographs or images provided.
ARTICLE 4 – PRICING
The rates provided by our simulator are indicative and may vary depending on the desired dates or times. To confirm a rate, a booking request should be sent. Smart Moov Biarritz Chauffeur LLC will confirm the details, including the service price.
Our rates include VAT and are expressed in Euros (€):
- The VAT rate for transfers is 10%
- The VAT rate for hourly services is 20%
The transfer rate applies to direct trips without stops, from pick-up to drop-off, as previously agreed upon. Any additional waiting time beyond the first 10 minutes will be billed at a rate of €80 (including VAT) per hour. Any additional kilometer beyond what was agreed upon will be charged €2 (including VAT) per km.
For hourly services, any additional hour beyond the contracted duration will be billed at €80 (including VAT). Rates are valid for up to 2 vehicles of the same category. For more than 2 vehicles, Smart Moov reserves the right to adjust its rates accordingly.
ARTICLE 5 – PAYMENT
Our services are payable in cash or by credit card, in euros, upon pick-up, except for our “Key Account” customers and Partners, who are billed periodically. We accept bank transfer, cash, and credit card payments (Visa, Mastercard, American Express).
Smart Moov reserves the right to request a deposit at any time to confirm a reservation. Any such deposit is non-refundable up to 100% of the booking’s total value. If the customer refuses to pay this deposit, Smart Moov may cancel the reservation and charge cancellation fees as outlined in these conditions.
ARTICLE 6 – CANCELLATION POLICY
Once confirmed by Smart Moov, bookings are non-cancellable, non-refundable, and non-modifiable. Any refund is subject to a €25 (including VAT) fee to cover management and payment charges.
ARTICLE 7 – LIMITATION OF LIABILITY
Smart Moov Biarritz Chauffeur LLC shall not be liable for delays related to rail or air traffic or any delays caused by road conditions beyond its control.
ARTICLE 8 – INSURANCE
Smart Moov Biarritz Chauffeur LLC holds liability insurance, and all our vehicles are insured for passenger transport, covering all bodily injury.
ARTICLE 9 – PERSONAL DATA
Smart Moov Biarritz Chauffeur LLC respects the privacy of its customers and complies with French data protection laws (Law No. 78-17). We will not disclose customer information to third parties, except for processing reservations.
ARTICLE 10 – DISPUTES
Any complaints must be submitted in writing to our Customer Service via registered mail within 8 days. Beyond this period, no claims will be considered. Subject to legal provisions, disputes fall under the exclusive jurisdiction of the Commercial Court.
